These terms and conditions are between you and Garner Entertainment LLC dba Glam It Up Events, including their respective affiliates and franchisees, and relate to the event specified on your application/reservation form. You should review all of the terms and conditions because together they create an agreement upon which we will rely in creating and producing the event.
BY CHECKING THE BOX ON THE RESERVATION FORM, YOU AGREE TO ACCEPT THESE TERMS AND CONDITIONS:
We require a $125 non-refundable deposit in order to secure your event date and time. Until your deposit has been received, you are not guaranteed the date or time requested, even if the item has been added to your cart. Your deposit will be applied to the cost of your event, but will not be refunded under any circumstances. Events booked less than 21 days prior will be subject to an “Expedite/Rush Fee” of $40.00 to cover express shipping of supplies.
We require payment in full for the event no less than 7 days prior to the start of the event. For your convenience, we accept Paypal, Zelle, Cash. as well as cash. Sorry we do not accept checks. While it is not required or included in your Party Package, gratuities are welcomed at your discretion and always appreciated. Your party hosts will indeed do a wonderful job and we look forward to celebrating with you!
3. RESCHEDULING AN EVENT; CANCELLATIONS
If you need to reschedule your event, we will apply your deposit to the rescheduled event if you have notified us of the change more than 15 days prior to the originally scheduled event date. If you are not able to notify us more than 15 days prior to the originally scheduled event date, your deposit will not be applied to the rescheduled event. If you cancel your event at any time and do not reschedule at the time of cancellation, your deposit will be not be refunded.
4. LIABILITY WAIVERS
All event guests are required to sign our liability waiver prior to the event kick-off. A parent or guardian must sign on behalf of any guest under the age of 18. We will be unable to allow anyone who has not furnished us with a completed and signed liability waiver to attend the event. THERE ARE NO EXCEPTIONS TO THIS RULE (5) EVENTS.
(a) The cost of your event typically covers guest only, not including the host parent(s)/guardian(s) and any parents/guardians who would like to stay. Adults are welcome to stay at no additional charge. However, food and activities will not be provided for adult guests unless you have arranged for it in advance.
(a) A FINAL ATTENDEE LIST IS REQUIRED NO LATER THAN SEVEN (7) BUSINESS DAYS PRIOR TO YOUR EVENT.
(b) Host parent(s)/guardian(s) must stay for the entire event. We will do our best to accommodate parents and siblings who wish to stay for the event; but again, we reserve the right to limit the total number of guests.
(c) Our mobile party lounge space is limited to party guest only.
(d) We provide clothing, costumes and props for each event. All clothing and costumes are washed after each use. Guests should wear appropriate undergarments (underwear, leotards, bodysuits, etc.). We reserve the right to charge you an additional amount for any items supplied by us that are damaged during the event or removed from the event.
(e) Glam It Up Events is not responsible for allergic reactions to wearing any costumes or consuming any food or beverages before, during or after the party. It is the responsibility of the guest and/or guests' parent or guardian to inform the client of any dietary restrictions. Please notify us of any allergies upon booking your party so we can govern ourselves accordingly. Glam It Up Events has provided this account of our policies and terms of service with the assumption that you have read and agree to our policies before reserving your party. Please ask for clarification if there are any questions regarding the above policies before reserving your party.
(f) Illegal substances are not allowed. Alcohol will not be allowed at parties with underage guest present.
(g) We host several events daily; therefore, guests will be admitted only at the scheduled start time for the event.
(h) Any guest arriving late will be permitted to join the event in progress. However, an event will not be extended beyond its scheduled end time due to late arrivals (even if the host parent(s)/guardian(s) are late).
(i) While we will do our best to manage any behavioral issues, ultimately it is the responsibility of the host parent(s)/guardian(s) to manage/resolve any misbehavior of any guest directed toward any other guest or our event coordinators, and to manage/resolve any behavioral issues of guests that otherwise disrupt the event.
(j) Services offered at event are for entertainment only. Additionally, the spa “treatments” are also for entertainment purposes only and not performed by licensed professionals. If your guests have allergies to any of the materials used (facial masks, nail polish, acetone, diary etc.) we will ensure an alternate activity is available to them.
Glam It Up Events dba Garner Entertainment LLC reserves the right to photograph/record events they design at your event in any and all promotional media, whether now known or hereafter existing, controlled by Glam It Up Events, in perpetuity, and for other use by Glam It Up Events. As a client of a Glam It Up Events, you agree that you will make no monetary or other such claim against Glam It Up Events for the use of any photographs taken of you, your child (or children), your home/event location and your guests. Glam It Up Events will under no terms use any identifiable information on our images. Should you have any concerns, please notify us on day of event.
7. EVENT LOCATION REQUIREMENT
If you choose to hold your event in your home, hotel, backyard, we request the area to be free of clutter and furniture. To ensure you have the absolute best experience we recommend adequate space for our spa “stations” and guests at your party.
(a) Accurate spacing requirement will depend on the party option you choose. On average, a large living room or den area, bonus room or the use of multiple rooms in a home will suffice.
(b) Mobile Party Lounge will require 4-5 average car lengths which is about 60 feet. Parking should be arranged prior to set-up time of event.
(c) Mobile Party Lounge must be parked on a flat surface for optimal use. Trailer cannot be parked on an incline, hill, slope or decline for the safety of all guests and hosts.
(d) Tents will be 10x10, 10x20, or 20x20 based on size of property.8. INDEMNIFICATION. You agree to indemnify and hold us, our members, managers, directors, officers, employees, representatives and agents harmless from and against any damage, harm, claims or other costs incurred by us, any of our employees or property, or any third party, arising out of or resulting from the acts or omissions of you, any of your guests or any of the parents/guardians of your guests, other than those caused by our own gross negligence or willful misconduct.
(a) These Terms and Conditions and the Liability Waiver constitute the entire agreement between you and us with respect to the subject matter hereof, and supersede all prior or contemporaneous agreements, understandings, proposals and communications, oral or written, regarding such subject matter. You acknowledge and agree by signing below you are representing that you are not relying on any statement, representation, warranty or understanding other than as expressly set out in these Terms and Conditions.
(b) These Terms and Conditions are for the benefit of you and us, and not for any other person.
(c) If any term, condition or provision, or any portion of any term, condition or provision, contained in these Terms and Conditions is determined to be invalid or unenforceable under any statute or rule of law, such provision shall be enforced to the maximum extent possible to give effect thereto, and the remainder of these Terms and Conditions shall remain in full force and effect to the maximum extent permissible without being impaired or invalidated in any way.
(d) No waiver of any of term or condition will be implied by failure to enforce such term or condition and no express waiver will affect any rights or remedies other than that to which the waiver is applicable and only for that occurrence. No term or condition shall be deemed waived, amended or modified by either party, unless such waiver, amendment or modification is in writing and signed by authorized representatives of party against whom enforcement is sought.
(e) These Terms and Conditions shall be governed by and construed in accordance with the laws of California without regard to the conflict of law’s provisions thereof. By acknowledging this Agreement, I acknowledge that I have had sufficient opportunity to read this entire Agreement and voluntarily agree to be bound by its terms.
